This Privacy Policy explains what personal data we collect, why we collect it, how we use it, and your rights under the General Data Protection Regulation (GDPR) and applicable Spanish data protection law.
2) Who this policy applies to
This policy applies to:
- Website visitors — anyone who visits www.agritecsoft.com
- Prospects and leads — anyone who submits a contact or demo request form
- Customers and account holders — organizations and individuals who purchase or use our Service
- Users — employees, contractors, or farm staff who access the Service on behalf of a customer
- Support contacts — anyone who contacts us for assistance
This policy does not govern the personal data that customers upload or generate inside the Service (farm production data, staff records, etc.). That data is governed by the Data Processing Addendum (DPA) in our Terms of Service or Cloud Services Agreement, where Agritec acts as a data processor on behalf of the customer.
3) What data we collect and why
3.1 Website visitors
When you visit our website, our web server may automatically record basic technical data including your IP address, browser type, operating system, referring URL, and pages visited. This data is processed to ensure the technical security and stability of the website.
Legal basis: Legitimate interests (GDPR Art. 6(1)(f)) — ensuring website security and preventing abuse.
Retention: Server logs are retained for a maximum of 90 days, then deleted.
We do not use analytics tools, tracking pixels, or behavioral advertising on our website.
3.2 Contact and demo request forms
When you submit a contact or demo request form on our website, we collect:
- Your name
- Your email address
- Your company name
- Any information you include in your message
We use this data to respond to your enquiry, assess your needs, and follow up with relevant information about our Service.
Legal basis: Consent (GDPR Art. 6(1)(a)) — by submitting the form, you consent to us processing your data to respond to your request. You may also be contacted for follow-up under our legitimate interests (Art. 6(1)(f)).
Retention: Contact form data is retained for 4 years from the date of your last interaction with us, after which it is deleted unless a customer relationship has been established.
3.3 Customer and account holder data
When you purchase a subscription or create an account, we collect and process:
- Identity data: name, job title
- Contact data: email address, phone number
- Company data: company name, address, VAT ID
- Billing data: billing address, VAT ID, invoice history
- Account data: username, account settings, subscription details, renewal dates
- Activity data: login timestamps, account activity logs
We use this data to:
- create and manage your account
- provide and operate the Service
- issue invoices and manage billing
- send subscription confirmations, renewal reminders, and service notifications
- provide customer support
- comply with legal and tax obligations
Legal basis:
- Contract performance (Art. 6(1)(b)) — account management, service delivery, billing
- Legal obligation (Art. 6(1)(c)) — tax and accounting records
- Legitimate interests (Art. 6(1)(f)) — security monitoring, fraud prevention, service improvement
Retention:
- Account data: retained for the duration of the subscription and for 3 years after termination, then deleted or anonymized
- Billing and invoicing data: retained for 6 years from the date of the invoice, as required by Spanish tax and commercial law (Ley 58/2003 General Tributaria; Código de Comercio Art. 30)
3.4 Support and helpdesk data
When you contact our support team by email or helpdesk ticket, we collect:
- Your name and email address
- The content of your messages and attachments
- Any account or technical information relevant to your request
We use this data solely to resolve your support request and improve our support quality.
Legal basis: Contract performance (Art. 6(1)(b)) and legitimate interests (Art. 6(1)(f)).
Retention: Support records are retained for 3 years from the date the ticket is closed, then deleted.
3.5 Marketing emails
If you have purchased our Service or submitted a contact form expressing interest, we may send you emails about product updates, new features, events, and relevant news related to our Service.
- Existing customers receive product and service communications based on our legitimate interests (Art. 6(1)(f)) under the soft opt-in rule applicable to existing business relationships. You may opt out at any time.
- Prospects (non-customers who submitted a contact form) receive marketing communications based on consent (Art. 6(1)(a)). You may withdraw consent at any time.
How to opt out: Every marketing email includes an unsubscribe link. You may also contact us at privacy@agritecsoft.com to opt out.
Retention: Marketing contact data is retained until you unsubscribe or withdraw consent, after which we retain only a minimal suppression record to ensure we do not contact you again.
4) Cookies
Our website uses only strictly necessary cookies required for the website to function (e.g., session management). We do not use analytics, advertising, or tracking cookies.
Strictly necessary cookies do not require your consent under the ePrivacy Directive. They are active whenever you visit our website and cannot be disabled without affecting website functionality.

We do not sell, rent, or trade your personal data. We may share your data with:
5.1 Subprocessors and service providers
We use trusted third-party providers to operate our Service and website. These providers act as data processors on our behalf and are bound by data processing agreements:

5.2 Payment processing
Online payments are processed through our bank's payment platform. Agritec does not have access to your card or payment credentials. Your payment data is handled exclusively by the bank under their own privacy policy and security standards.
5.3 Legal and regulatory obligations
We may disclose personal data to competent authorities (tax authorities, courts, regulators) when required by applicable law or a binding legal order.
5.4 Business transfers
In the event of a merger, acquisition, or sale of substantially all of our assets, your personal data may be transferred to the successor entity. We will notify you before your data is transferred and becomes subject to a different privacy policy.
6) International data transfers
Our Service is hosted on Microsoft Azure in the United States. When we transfer personal data from the European Economic Area (EEA) or the UK to the United States, we rely on:
- The EU–U.S. Data Privacy Framework (DPF) where Microsoft is a certified participant
- EU Standard Contractual Clauses (SCCs) for processor transfers
- The UK International Data Transfer Agreement/Addendum for UK personal data

7) Your rights
Under GDPR, you have the following rights regarding your personal data:

8) Data security
We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, loss, or destruction. These measures include encryption in transit and at rest, access controls, and regular security monitoring. No method of transmission over the internet is 100% secure. If we become aware of a personal data breach affecting you, we will notify you as required by applicable law.
9) Children's data
Our Service is intended exclusively for business use. We do not knowingly collect personal data from individuals under the age of 16. If we become aware that we have inadvertently collected such data, we will delete it promptly.
10) Changes to this policy
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. We will indicate the update date at the top of this page. For material changes, we will notify existing customers by email at least 30 days before the change takes effect.
